General Terms and Conditions

Last updated: 10 October 2026

The terms and conditions for the design, booking and performance of your journey with ADERO Travel.

Introduction

ADERO Travel B.V. specialises in designing, combining and arranging personalised tailor-made trips. These Terms set out the rights and obligations relating to the design, booking and performance of travel and individual travel services. ADERO Travel may act as an organiser, intermediary or provider of a standalone travel service. The legal nature of the agreement determines the applicable rights. Mandatory Dutch and European law always takes precedence.

PART I – GENERAL PROVISIONS

Article 1 – Definitions

ADERO Travel: ADERO Travel B.V., established in the Netherlands.

Traveller: any person entitled under a travel agreement to travel or receive a travel service.

Lead Booker: the person booking for themselves and possibly other travellers.

Organiser: a business that combines and sells or offers packages.

Intermediary: a business arranging an agreement between the traveller and a third-party service provider.

Package and Linked Travel Arrangement: combinations of travel services meeting the relevant statutory definitions.

Travel Service: including passenger transport, accommodation, certain vehicle rental or another tourist service.

Tailor-Made Trip: a trip designed around individual preferences.

Design Fee: a separate charge for travel design.

Trip Price: the total price including legally mandatory charges.

Service Provider: a third party performing a component.

Travel Proposal: proposed itinerary, services and prices.

Travel Agreement: agreement for the relevant travel services.

Durable Medium: including email or a downloadable document.

Unavoidable and Extraordinary Circumstances: events beyond the affected party's control whose consequences could not have been avoided despite reasonable measures.

Article 2 – Applicability

These Terms apply if provided and declared applicable before or when the agreement is concluded. Part I applies generally, Part II to packages and Part III to intermediation and linked travel arrangements. The actual nature of the booking determines its legal classification. Variations must be validly and timely agreed. Mandatory law always prevails.

Article 3 – Services and Role of ADERO Travel

ADERO Travel designs personalised trips and may arrange flights, accommodation, cruises, rail and ferry services, transfers, car rental, excursions, guides and other tourist services. The travel proposal and booking confirmation describe the services and, where relevant, ADERO Travel's role as organiser, intermediary or independent provider. Legal classification depends on the actual booking structure.

Article 4 – Travel Enquiry and Information Provided by the Traveller

The traveller provides accurate and complete information about destinations, dates, budget, travel party, preferences and other relevant circumstances. The Lead Booker ensures that the necessary information is obtained and shared with fellow travellers. Relevant changes must be reported promptly.

Article 5 – Travel Proposal and Availability

Proposals are based on information, prices and availability at the time and are non-binding unless stated otherwise. Reservations are final only upon confirmation. Images and sample itineraries are illustrative; agreed characteristics and legally relevant information remain decisive. Alternatives are not booked definitively without the required consent.

Article 6 – Design Fee

ADERO Travel may charge a Design Fee, disclosed and confirmed in writing in advance, for developing a personalised tailor-made trip. Depending on the assignment, it covers assessing travel preferences, researching destinations, developing itineraries, comparing travel services and presenting a personalised travel programme. The scope and number of included revision rounds are stated in advance. The Design Fee is accounted for separately from the trip price until the booking is confirmed. OFFSET: The Design Fee already paid by the traveller is deducted in full from the total trip price when the traveller definitively books the tailor-made trip designed by ADERO Travel through ADERO Travel. The deduction is clearly shown on the booking confirmation and/or invoice. The Design Fee therefore does not constitute an additional charge on top of the agreed trip price. Additional work is charged only with prior consent. If the traveller does not book, the fee for agreed and performed design work generally remains payable, subject to statutory rights. Early termination takes account of work performed, contractual arrangements and applicable law. Any withdrawal rights for separately contracted distance design services are respected; they are not automatically excluded merely because the assignment concerns travel. If the trip is subsequently cancelled, the Design Fee already deducted is not charged again separately.

Article 7 – Formation of the Agreement

The agreement is formed under applicable law following acceptance of the offer and the agreed booking procedure. ADERO Travel provides the required confirmation on a durable medium. The Lead Booker checks it and reports errors promptly. Obvious mistakes are not binding to the extent permitted by law.

Article 8 – Lead Booker and Fellow Travellers

The Lead Booker must be authorised to act for the travellers concerned, ensure they receive relevant information and provide correct details. Payment obligations and any joint and several liability arise only from the agreement and applicable law.

Article 9 – Trip Price and Pricing Information

The trip price is clearly stated in advance and includes legally mandatory charges. Charges that cannot be calculated precisely in advance are separately identified where required. Personal expenses and optional services are excluded unless included. The pricing unit is specified. Any Design Fee already paid is deducted in full upon definitive booking.

Article 10 – Payments

Unless agreed otherwise, the deposit for the land arrangements is 25%. Full advance payment may apply to components requiring immediate issuance or subject to special terms, including flights, cruises, rail or ferry tickets, accommodation, events and admission tickets. The balance is payable no later than six weeks before departure unless otherwise agreed; bookings made later may require immediate full payment. Different deadlines are communicated in advance. Any Design Fee already paid is deducted on the invoice. Statutory requirements concerning advance payments and insolvency protection remain applicable.

Article 11 – Late Payment

In the event of late payment, ADERO Travel may issue a reminder and, where required, grant a reasonable additional payment period. The agreement may subsequently be terminated insofar as permitted by law. Interest, collection charges and termination fees are payable only where legally or contractually justified.

Article 12 – Travel Documents and Correspondence

ADERO Travel provides agreed and legally required documents in good time. The traveller checks them and reports inaccuracies. Communications may be electronic; the traveller keeps contact details up to date.

Article 13 – Names and Personal Data

Names must match official travel documents. Errors attributable to the traveller may lead to substantiated amendment costs or replacement tickets. Personal data is processed under the Privacy Policy and applicable law.

Article 14 – Passports, Visas and Entry Requirements

The traveller must hold the necessary passports, visas, travel authorisations and other documents. ADERO Travel provides legally required general information on passport, visa and health formalities. The traveller checks individual requirements and changes in good time. Liability for missing documents depends on attribution of fault and applicable law.

Article 15 – Health, Mobility and Special Circumstances

The traveller promptly discloses relevant special needs, such as reduced mobility or necessary facilities. ADERO Travel examines possibilities within the assignment. The traveller obtains individual medical advice. Sensitive data is processed and shared only lawfully and when necessary.

Article 16 – Special Requests

Requests concerning diet, bed type, room, seating or facilities are passed on where possible. A preference is guaranteed only if expressly confirmed as a contractual obligation.

Article 17 – Travel Insurance

ADERO Travel strongly recommends appropriate travel and cancellation insurance covering medical expenses, repatriation, luggage and planned activities. Insurance does not replace ADERO Travel's statutory obligations.

PART II – PACKAGE TRAVEL TERMS

Article 18 – Application to Package Travel

This Part applies when ADERO Travel acts as package organiser. ADERO Travel is responsible for proper performance of all agreed travel services, including those supplied by third parties. Statutory package travel rights remain fully applicable.

Article 19 – Mandatory Pre-Booking Information

ADERO Travel supplies the statutory standard information form and relevant details concerning destination, itinerary, dates, transport, accommodation, meals, excursions, accessibility, total price, payments, minimum participant numbers, travel documents, insurance, cancellation and insolvency protection. Legally relevant information forms part of the agreement.

Article 20 – Contents of the Package Travel Agreement

The agreement sets out the travel services, accepted special requests and required contractual information. The traveller receives confirmation on a durable medium and contact details for assistance during the trip.

Article 21 – Price Changes After Booking

A price increase is permitted only if contractually provided for and legally justified by changes in passenger transport fuel/energy prices, third-party taxes/charges or relevant exchange rates. Corresponding price reductions apply where these costs decrease. Increases must be communicated on a durable medium, with reasons and calculation, at least twenty days before departure. Increases exceeding 8% trigger statutory rights relating to significant changes.

Article 22 – Minor Changes Before Departure

Insignificant changes are permitted only where the right to make them has been reserved and the traveller is clearly informed on a durable medium. Significant changes are governed by the relevant statutory rules.

Article 23 – Significant Changes Before Departure

If a principal characteristic is significantly changed, the traveller is informed of the change, price consequences, response deadline and option to terminate without a fee. The traveller may accept or terminate. An alternative may be offered where possible. Lower quality or value may entitle the traveller to a price reduction; refunds follow statutory deadlines.

Article 24 – Cancellation by the Traveller

The traveller may terminate before departure, preferably in writing. The date ADERO Travel receives the notice is the cancellation date. Unless other lawful terms were agreed, the standard scale is: More than 90 days before departure: 25% of the trip price.
90–61 days: 35%.
60–31 days: 50%.
30–15 days: 75%.
14 days or fewer: 100%. The standard termination fee remains subject to statutory reasonableness requirements, including cost savings and income from alternative use. ADERO Travel provides justification upon request. Different charges may apply to components disclosed in advance as non-refundable or partially refundable, including flights, cruises, accommodation, events and permits, insofar as legally permitted. Charges are never duplicated. The Design Fee already deducted upon booking is not charged again separately. Suitable cancellation insurance is recommended.

Article 25 – Termination Without a Fee Due to Extraordinary Circumstances

Where unavoidable and extraordinary circumstances at or near the destination significantly affect performance of the package or transport to the destination, the traveller may cancel without a termination fee under statutory conditions. Payments are refunded in accordance with the law; additional compensation is not automatically payable.

Article 26 – Transfer of the Package

The traveller may transfer the package to a person meeting all travel conditions and must notify ADERO Travel in good time on a durable medium. Notice at least seven days before departure is always considered timely. Only actual, substantiated and reasonable transfer costs may be charged. Some tickets may require new reservations.

Article 27 – Changes Requested by the Traveller

ADERO Travel investigates requested changes subject to availability and applicable terms. Substantiated price differences, supplier charges and reasonable handling fees agreed in advance may apply. Costs are communicated in advance where possible. Changes become final only upon confirmation.

Article 28 – Termination by ADERO Travel

If a previously disclosed minimum participant number is not reached, ADERO Travel may terminate subject to statutory notice: at least 20 days before departure for trips longer than six days, seven days for trips of two to six days and 48 hours for shorter trips. Termination is also possible due to unavoidable and extraordinary circumstances as permitted by law. Refunds and any compensation follow statutory rules.

Article 29 – Performance of the Package

ADERO Travel is responsible for proper performance, including services supplied by third parties. The traveller reports shortcomings without undue delay. ADERO Travel remedies them within a reasonable time unless impossible or disproportionately costly. Subject to statutory conditions, the traveller may arrange a remedy and claim necessary expenses. Appropriate alternatives are offered if a significant part cannot be performed.

Article 30 – Alternative Travel Services During the Trip

If significant components cannot be performed, ADERO Travel provides suitable alternatives where legally required, preferably of equivalent or higher quality, at no extra cost. Lower quality may warrant a price reduction. Rejection and any rights to return transport or compensation are governed by law.

Article 31 – Assistance

ADERO Travel assists travellers in difficulty without undue delay, including information on healthcare, authorities, consular support and alternative arrangements. Appropriate emergency contact details are provided. Where difficulties were intentionally or negligently caused by the traveller, only a legally permitted fee not exceeding actual costs may be charged.

Article 32 – Unavoidable Circumstances During the Trip

Where return travel becomes impossible due to unavoidable and extraordinary circumstances, ADERO Travel bears necessary accommodation costs as required by law, generally for up to three nights, subject to exceptions and more favourable rights. Additional protections apply to certain travellers with special needs.

Article 33 – Price Reduction and Compensation

Non-conforming performance may entitle the traveller to an appropriate price reduction and compensation. Statutory exclusions and applicable international conventions and European rules are respected.

Article 34 – Liability of ADERO Travel

As organiser, ADERO Travel is legally responsible for performance, including performance by third parties. To the extent permitted by law, compensation for damage other than personal injury and damage caused intentionally or negligently may be limited to three times the total trip price. Statutory exceptions, international conventions and rules preventing double recovery remain applicable.

Article 35 – Insolvency Protection

For packages and linked travel arrangements requiring protection by law, ADERO Travel arranges the necessary protection before offering and selling them, including refunds and, where relevant, repatriation. Travellers receive the required details of the protection provider in advance. This clause does not claim existing membership in any particular scheme.

PART III – INTERMEDIATION AND INDIVIDUAL TRAVEL SERVICES

Article 36 – Intermediation of Travel Services

In genuine intermediation, the travel service agreement is concluded directly between the traveller and the service provider. ADERO Travel identifies its role and, where required, the contracting party and relevant terms. ADERO Travel remains responsible for its own careful intermediation but is not automatically responsible for the third party's performance. Statutory exceptions apply.

Article 37 – Booking Instruction for Intermediation

The traveller provides a clear instruction. ADERO Travel checks price, availability and terms as appropriate. Formation follows the applicable booking procedure. The traveller receives confirmations and legally required information.

Article 38 – Intermediation Fees

A separate intermediation fee is payable only if clearly agreed in advance. Amendment and handling charges require a valid legal basis. The Design Fee is not automatically an intermediation fee; upon definitive booking of the tailor-made trip, the previously paid Design Fee is deducted in full.

Article 39 – Cancellation of Individual Travel Services

For genuinely separate bookings, the supplier's terms disclosed in advance may apply. Non-refundable fares are possible. ADERO Travel charges its own fees only where legally justified. A booking qualifying as a package cannot be deprived of package travel rights through separate invoices or supplier terms.

Article 40 – Linked Travel Arrangements

Where the booking process legally constitutes a linked travel arrangement, ADERO Travel provides prescribed information and arranges required insolvency protection. Each provider is generally responsible for its own agreement, subject to statutory obligations. Failure to meet information or protection duties may give rise to additional statutory rights.

Article 41 – Legal Classification of Combined Bookings

The actual content and booking structure determine whether a package exists. Separate invoices, payments or descriptions such as 'tailor-made trip' or 'intermediation' are not decisive. Where a booking legally qualifies as a package, all package travel rights apply.

PART IV – SPECIFIC TRAVEL SERVICES

Article 42 – Flights and Air Transport

Applicable carriage conditions and laws govern flights. Schedules, routes and aircraft may change. ADERO Travel communicates relevant changes in accordance with its obligations. Travellers check flight details, check-in times and baggage rules. European or international rights may apply in cases of delay, cancellation or denied boarding alongside package rights, without double recovery.

Article 43 – Baggage

Baggage allowances vary by carrier and fare. Additional baggage may incur charges. Valuables, medicines and documents should be transported carefully. Loss, damage or delay should be reported promptly under applicable procedures. Liability is governed by law, contract and conventions.

Article 44 – Accommodation

The booked accommodation is specified in the confirmation. Ratings vary between countries. Check-in and check-out times are set by the property unless agreed otherwise. Facilities may be seasonal; statutory rights apply if an agreed essential facility is unavailable. Known charges that must legally be disclosed are communicated in advance.

Article 45 – Transfers and Local Transport

Travellers follow pickup instructions and report relevant delays. Additional costs for transfers missed due to circumstances attributable to the traveller may be charged where lawful. For packages, ADERO Travel remains responsible for agreed transfers.

Article 46 – Car Rental

Agreed rental terms govern driving licence requirements, age, deposits, payment cards, fuel policy, mileage restrictions, excess and insurance. Travellers inspect the vehicle and report damage on collection. Package travel rights remain applicable.

Article 47 – Cruises, Rail Travel and Ferry Services

Specific carriage and booking conditions may apply. Travellers must observe boarding times and safety rules. Routes and ports may change, subject to statutory package and passenger transport rights.

Article 48 – Excursions and Activities

Activities are provided as agreed. Travellers follow safety instructions and disclose relevant participation limitations. Weather and safety may require changes. Statutory package rights apply to changes or non-performance.

Article 49 – Local Conditions and Travel Experience

Countries differ in climate, infrastructure, hygiene, service and customs. ADERO Travel provides relevant information as legally required. Travellers should allow for reasonable local conditions. This does not restrict rights to agreed services.

PART V – OBLIGATIONS, COMPLAINTS AND LIABILITY

Article 50 – Conduct and Responsibilities of the Traveller

Travellers comply with laws, safety rules and reasonable instructions and respect others. Seriously disruptive behaviour may justify lawful measures. Proven damage attributable to the traveller may be recovered.

Article 51 – Safety and Travel Advice

ADERO Travel takes relevant destination information into account. Travellers should consult official travel advice. A change in advice does not automatically entitle the traveller to free cancellation; the specific statutory criteria apply. Safety is prioritised without an absolute guarantee against risk.

Article 52 – Complaints During the Trip

Shortcomings must be reported to ADERO Travel without undue delay and, where appropriate, to the local provider. ADERO Travel investigates and remedies them where required. The traveller provides reasonably available information. Late notification does not automatically extinguish statutory rights.

Article 53 – Complaints After the Trip

Unresolved complaints may be submitted in writing after travel, preferably promptly and with the booking reference and supporting information. ADERO Travel acknowledges receipt and responds within a reasonable period. Statutory limitation periods and access to competent authorities remain unaffected.

Article 54 – Liability in Intermediation

ADERO Travel is responsible for its own intermediation; the separate provider is generally responsible for performance. ADERO Travel may be liable for its own attributable failures. Statutory liability and package rights are not excluded.

Article 55 – Liability of the Traveller

The traveller is liable for damage arising from an attributable breach or unlawful act as provided by law. Circumstances not attributable to the traveller do not create liability.

Article 56 – Mitigation of Loss

Both parties take reasonable measures to prevent or mitigate foreseeable loss. ADERO Travel seeks appropriate solutions; the traveller reasonably cooperates. Statutory rights remain unaffected.

PART VI – OTHER PROVISIONS

Article 57 – No General Right of Withdrawal for Travel Bookings

Certain travel agreements, including packages and dated transport, accommodation, car rental and leisure services, are not subject to a general fourteen-day withdrawal right. Statutory termination rights remain applicable. Any withdrawal right for a separate design service is assessed independently.

Article 58 – Intellectual Property in Travel Designs

Original itineraries, texts and presentations may be protected by intellectual property rights. Travellers may use them for the agreed purpose. Commercial reuse beyond those rights requires permission, subject to statutory exceptions. No exclusive rights are claimed over general destination information or facts.

Article 59 – Privacy and Data Protection

ADERO Travel processes personal data under the GDPR and its Privacy Policy. Data may be shared with service providers where lawful and necessary. Transfers outside the EEA are subject to applicable safeguards.

Article 60 – Website and Electronic Communications

Website information is maintained carefully and may be updated. Existing agreements do not automatically change as a result. Electronic communications comply with law and agreed arrangements.

Article 61 – Amendments to These Terms

ADERO Travel may amend the Terms for future agreements. Existing agreements generally remain governed by the terms validly accepted when concluded. Changes to existing contracts are permitted only under law and the agreement.

Article 62 – Invalidity or Unenforceability

If a provision is invalid, the remaining provisions continue to apply to the extent legally possible. The invalid provision is not enforced; any replacement must comply with the law.

Article 63 – Governing Law

Dutch law applies insofar as a valid choice of law is possible. Mandatory consumer protections under applicable European and international rules remain unaffected. Separate foreign service providers may be subject to other laws.

Article 64 – Disputes

The parties first seek an amicable solution. Complaints may be submitted to ADERO Travel. If unresolved, the courts competent under applicable law are available. Mandatory consumer protections are not restricted. No membership in a particular dispute resolution body is claimed.
